1. Agreement to Terms

By using the services provided by Cyber Server Sea (SMC-Private) Limited ("Company," "we," "us," or "our"), you agree to be legally bound by these Terms of Service. These terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and the Company concerning your access to and use of our web hosting, domain registration, and related services.

2. Provision of Services

We provide a variety of hosting solutions, including Shared, WordPress, VPS, Dedicated, and Reseller hosting. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, including hours of operation and availability of any service feature, without notice and without liability.

3. User Account Responsibilities

To access our services, you must create a user account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or otherwise suspect any security breaches related to our services.

4. Acceptable Use Policy (AUP)

You are prohibited from using our services for any illegal or unauthorized purpose. Prohibited activities include, but are not limited to:

• Illegal Content: Hosting, distributing, or linking to child pornography, pirated software, or materials that violate intellectual property laws.
• System Abuse: Attempting to bypass security measures, performing DDoS attacks, or overloading our infrastructure.
• Spamming: Sending unsolicited bulk email (SPAM) or hosting mass-mailing software.
• Phishing: Hosting fraudulent websites designed to trick users into providing sensitive information.

5. Billing & Payment

All services are provided on a pre-payment basis. You agree to pay all charges incurred in connection with your account at the rates in effect when the charges were incurred. All fees are non-refundable except as provided in our Refund Policy. Automatic renewals will be processed 7 days prior to the expiration of the service period.

6. Intellectual Property

The Company owns all right, title, and interest in and to our services, including all intellectual property rights. You retain ownership of all content you upload to our servers. However, you grant us a limited license to host and backup your content as necessary to provide the services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its employees, contractors, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or from any content uploaded to your account.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Lahore, Pakistan.
